Yes, go to the FOS. 8 weeks started running from then. FOS should then write to Lowells.

The Leeds Losers are great at making up imaginary payments. Apparently I paid £1 into a bank 200 miles from home on a Sunday.

The onus of proof fall entirely upon Lowell that you made the alleged payment.
Has Lowell provided this information in writing?
Is the bank a branch of your bank?

This was a verrrry long time ago Nem. The Leeds Losers gave up on me years ago. Thanks to over the road and Beagles DCAs hold no fears for me now!

Hello there (ANOTHET UPDATE) :tinysmile_twink_t2:

i have today received some correspondence from Lowells (via email) that says...

"Following on from our previous email in acknowledgement of your complaint, we are writing again to advise we are still investigating the details of your concerns.

Unfortunately, we have not yet completed the investigation that will allow us to respond fully.

Please accept our apologies for the delay and thank you for your patience. Be assured that we will write to you again as soon as possible but no later than 8 weeks from the date we received your complaint."

It feels like they have not taken what I've said seriously regarding the 8 weeks from my original letter and me threatening to contact the FOS.

Should I respond to them in anyway or just wait and see what the outcome of me raising this with the FOS is?

Unfortunately arbitrary time scales set by individuals and DCA's are basically meaningless, where as the 56 day time scale for a Formal Complaint to be investigated can be relied upon, no satisfactory response or no response at all leaves you free to take the case to the FOS.
So wait out the 8 weeks from the date your letter was sent, 2 working days after posting is acceptable date of receipt .

Hello everyone!

The the sun is shining and I am in a very good mood!

I have today, finally, received correspondence from Lowells regarding my complaint.

Over two two pages they rambled on about how the purchased the debt and after some investigation they have confirmed that the last payment was made in September 2012 - what a load of rubbish!! With this in mind "the account is not statute barred". Then, I turned over the page to read "however, with a view to resolving this matter without further delay and with no admission of liability, I have decided to close the account and confirm that no further action will be taken"

I just wanted to take this opportunity to thank you all at Legal Beagles for all the help, support and advice given to me these past few months! I am so so grateful!!

I can now relax and look forward to the future - away from Lowells!
