    Thanks for your quick response. I have a Section 78 request letter printed and ready to post, so this will go off today to the same address that you have provided.

        The default date will be 3 to 6 months AFTER you made the last payment.
        This means you have to simply BUY time until around end of april, but just to be safe go all the way till end of june.

        And MAKE sure they dont throw an SD at you about 2 months before it would become statute barred. They have a nasty habit of that.

        EDIT: the best way is keep writing asking them things, so at all times you are in "negotiation" thus they will find it hard to justify any legal action.
        Get a copy for your credit report, and start asking them for all sorts of confirmations, this will result in them having to answer each letter, if you space them out a week apart thats a total of 26 letters for a full 6 months of pure nonsense.

        On the friday send the letter, do them simple:

        Dear XXXXXX

        I have recieved my credit report, can you tell me what this entry means:
        OK OK OK OK OK OK OK

        Yours sincerely

        XYZ

        They reply or dont reply.

        Next week

        Dear XXXXXX
        I still do not acknowledge any debt to you.

        Have you got the information i requested?


        And so on and so forth......

        Remember you dont really expect them to reply, your just buying time. Every 2 weeks add i dont acknowledge and you want proof....

        This will prevent them starting an SD and going for bankruptcy, as you can show you were asking them at every stage for months for proof you owed them anything and they wouldnt send it.

          Hi blanker,
          Many thanks for your thoughts....................as far as I am aware, the statute barred date starts to run from when the 'cause of action' started, being when you started to miss the monthly payment, and not when a default notice was recorded on your credit file, as you are obviously in default once you miss a payment.
          Also ,I am aware that the 'cause of action' can be either one or two months of missed payments, which is why I am playing for time.
          I would appreciate the thoughts of others on this so I don't mess this up.

            Blanker a Statutory Demand does Not affect the LA 1980 limitation period of 6 years, only payment, written acknowledgment and the issue of a CC claim stops the clock.
            I'm afraid your approach is more likely to lead a creditor/DCA into issuing a final response/letter before action and issue of a claim, many times over the last year we have seen the likes of Cabot and Lowell doing just this a couple of weeks prior to the debt possibly becoming statute barred, dealing with debts is not a game to be played with debt purchasers with the money, time and legal resources to pursue debts to their desired conclusion.

              Thanks for putting blanker right..................I would have hoped that someone offering their opinion, it would be through personal experience or some kind of work related knowledge.......................not stabbing in the dark, and suggesting writing 26 letters!!

                  There is also a lot of wrong or misguided information out there on the internet or even some other forums. It's not always easy to separate the wheat from the chaff unless you have been doing this for some time.

                    Update.................After recently sending a CCA request to Lowell's, I got a few letters from them stating that they were requesting a copy of the agreement from Capital One. It went quiet for a couple of weeks, then I got a rather pleasing letter that said Capital One cannot provide them with a copy of an agreement due to the age of it, and so they have closed this account.
                    Kerching............£10,000 wiped off.......
                    I would just like to say a big thanks to those who have assisted me in dealing with this, and which also gave me the balls to fight these scumbags.

                      Even assuming the Leeds Losers only paid 1% of the value of that debt thats a hundred quid you have cost them. Even an infinitessimal amount such as this is pleasing
