  • URGENT HELP - Barclay card default notice

    Good evening,

    new to to the site so first of all hi to everyone and thank you for any help/guidance/advice anyone can give.

    Just opened a letter from Barclay card enclosed was a default notice to say I had until 28th October to pay £140 other wise a default notice would be carried out.

    So as I am new to this am I correct in thinking I have until 28th to pay the £140 and then proceed to make the monthly repayments and no further action will be taken?

    I understand and it is my fault I am in this position however I am in a position I can pay the £140 on 24th along with the regular monthly repayments there after.

    any help is greatly appreciated, as you can expect opening the letter to find that was a shock as I do not deer stand the implications of the action.

    Most at of all I cannot have anything on my file such as ccj's or default notices etc due to my employment.

    Hi dan,

    They have given you the date to pay the arrears or they will put a default notice on your credit file. The default notice as been sent to give you the time to pay you could speak to barclays to verify this matter

      Hi,

      i am am going to call tomorrow morning I only read the letter when I got in from work.

      So so I am correct in thinking I can pay the £140 stop the default notice and carry on by paying my monthly repayments?

        Also what is a default notice and what implications do they have against you, sorry I am new to this sort of thing.

          Hi dan,

          A default notice is a official document sent by a credit telling you what you need to do too bring your account back into balace. Its usually sent when 3-6 payments are missed.
          They are very serious can stop you getting any form of credit and that would include a mortgage they stay on your credit file for six years

            Strictly spearing the notice you received would be the section 87 notice served under the consumer credit act.
            This gives you 14 days to pay the arrears and if you do the breach is considered not to have been committed as regards to the commencement of proceedings in court, so it means that if you pay the arrears they cannot take you to court or terminate the contract on the breach of the agreement.
            This means that you will be able to repay the card at the contractual rate. It does not mean that they have to re instate the credit facility however.

            In itself it also does not man that they cannot enter a default on your credit file, generally a default is entered after six missed payment but it can be entered earlier, they should issue a warning before entering a "D" on your file 28 days before doing so, but this is not a legal requirement only a guideline, sometimes this notice is included within the section 87 notice, in which case if you pay then you are safe also from getting the default marker , so I would re examine your notice.

              It is very serious then! I am going to call them in the morning also as i say i have no issuea making the payments going forward ao hopefully i can get all of this behind me.

                So from what your saying is i could pay the £140 yet they could still ad a default notice to my credit file anyway?

                    I have read over the form again, the form is a default notice under section 87.

                    I must pay £140 by 28 october, if i do so no further action will be taken under the enforcement of the breach.

                    So does this mean if i pay the £140 then a default will not be logged against my credit file.

                    I have also taken pictures of the letter whixh i can upload so people can confirm the correct wording.

                      Yes if you can scan it and pwot it on here, it should say issued under section 87 of the consumer credit act at the top.You need to check it to see if it mentions recording the default on a credit file also. But yes putit up by all menas.The notice in of itself is about giving you chance to pay before the commence proceedings nothing else as said(they cannot by statute), but sometimes they also add the CRA notice thing as extra encouragement.

                        The default on your credit file is a record of the time when the relationship between you and the creditor broken down, nothing to do with the section 87 notice, this is a statutory requirement which mist be issued prior to the commencement of proceedings, it would be as well to check your credit report to see if the default has not already been put on there, if not you stand a good chance of them not doing so if you pay this promptly.

                          I have taken pictures with my phone i dont think i can attach them that way. I can send them to your home email?

                          As above i cannot see anything which mentions anything about adding anything to my credit file on the letter, however in bold capitals it does say as above if i do pag by the given date then no further action will take place under the breach.

                          I am sorry to ask so many questions i am just extremely worried now, as i say i know this is my doing however i want to get this aorted asap.

                            I have missed payments however never been advised my credit file has had a default registered or is a default the term used for missed payment?

                            My main concern is the further action that can be taken by this section 87 if no payment is made by 28th october but i can assure you the payment will be made 8am on the 24th so no issues with that not happening.

                              Yes if you pay the sum required to remedy within the time, they CANNOT take you to court.

                              However it is possible to enter a "D" on your file in any case. You should check your credit file, Noddle do a free on line check I would advise you get o there and have a look.
