    I wasn't sure where to post this so apologies if it is in the wrong place.#

    I am currently pursing a complaint against Thomsons, for breach of duty of care(breach of contract) on a recent package holiday and wondered if anyone else had any experiences with this.

    I have written a formal complaint to them and then to the regulator (ABTA).

    Thompsons 14 days to reply to the abta complaint ends on Monday.

    I am unsure which avenue to follow next. I have been told that the ABTA route is very slow and have not really had any positive reports, however settlement through these are usually covered by a confidentiality agreement,so I do not suppose you would.

    They want £180 to cover the court costs which to me seems a bit steep when you compare it with what it would cost me to commence a claim in the SC court. Also if this failed I apparently would not be able to claim through the county court subsequently.

    The upside would be that it would all be done without having to attend(is that a good thing?)

    I really want to pursue this as there are disability issues that would effect other disabled holiday makers, so perhaps the small claim would be better. I would be interested if anyone had any thoughts.

    II thought I would finish this since it now seems to be resolved. Basically , I am a wheelchair user on occaision, and requested assistance form Thomson on a holiday to Crete. This was not provided at the destination airport, which resulted on some problems for me and the Mrs.
    On the initial complaint they offered a voucher for £50. This we refused and commenced a complaint through ABTA.

    They then offered £500 once they had received the complaint form ABTA , someone rang on a Sunday afternoon. Eventually they settled on £700(cheque), I refused any confidentiality, and in fact have been discussing this, much to their chagrin on the Thomspon Facebook page(not that it stays up for long).

    For anyone else pursuing this kind of claim I recommend making your complaint as public as possible, it seems to be far more effective than any ombudsman scheme.
