    I have been reading the cab website in regards to baliff visits and at one point it says this

    Proving who owns things

    Make it clear to the bailiffs who the things belong to if they aren’t yours. You may have to show them proof of ownership, for example, a bill or a credit card receipt. Or the owner of the goods could swear a statement to say that the goods belong to them.


    How would you go about swearing a statement? what steps would i need to take? would i have to go to a scoliciter? doeas anybody know the cost for this?

      You have to swear a oath at a solicitors cost about a tenner this is a legal document that says you own what is listed

          Thanks everybody for all your help the link on this thread doesnt lead anywhere is there a template Statutory declaration anywhere which i could modify and use?.

            Statutory Declaration For Goods Belonging to Someone Else

            Bailiffs cannot seize goods belonging to someone else, but they are allowed to assume that anything in a property is yours, unless they are provided with proof such as receipts.
            Failing this documentary proof. the third party can make a statutory declaration that certain named items belong to him and may not be seized.

            This costs about £5 if sworn before a commissioner for oaths/solicitor who signs and stamps it.

            Then you scan it, email it, fax it, post a hard copy recorded delivery. The bailiffs should then release these items from the levy.
            STATUTORY DECLARATION

            To: (the bailiffs) (their address)

            I (your name)

            of (your address)

            Do solemnly and sincerely declare that:

            the items listed (list them)
            are not the property of (your friends name) and (reason why they were there) and have always been my sole property

            And I make this solemn declaration conscientiously believing the same to be true and by virtue of the provisions of the Statutory Declarations Act 1835 and Section 5 of The Perjury Act 1911.

            Signature:

            Declared at

            On the day of two thousand and

            Before me

            A Commissioner for Oaths, or Notary Public/Justice of the Peace/Solicitor having the powers conferred on a Commissioner for Oaths

              I have a couple of questions if i was to modify this Declaration so it wasnt to any specific bailiff just to be shown to anybody how would i do it? would i just not fill in the bailiffs name and address section?

              Also this part confuses me (On the day of two thousand and ) if i wanted it for the 13 of January 2015 what would the wording be changed too?

              And one last one when i am filling in the blanks should it be done with pen or can i do it on a computer obviously i understand the signiture has to be in pen.

              I would be grateful for any help on this.

                    A stat dec does not need to be addressed to anyone in particular, so you can just omit that part.

                    The date thing is just "On the 13th day of January Two Thousand and Fifteen" (if that is the date you actually make the declaration.

                      Many thanks Steve for the response should i just use a pen to fill in the blanks ie what items etc or computer or a bit of both will it make a difference? then do i have to submit it to a solicitor for them to sign?.

                        You can complete the whole thing on your computer.

                        You need then to actually make the declaration in front of a solicitor, they will ask you to say your full name and say and then make a formal declaration that the contents of the document are true.

                        They then countersign it.

                        The fee is fixed at £5 plus £2 per exhibit (if anything is attached to it).

                        I'm not suggesting that you would, but you should be aware that it is an offence to make a false declaration carrying a prison sentence of up to two years.

                          My partner has receipts and credit card bills in her name for the items she owns at the property.

                              If I were in your circumstances, I would do both.

                              It is probably fair to say that bailiffs in general are not noted to be the sharpest knives.
