  • Dundalk Debtor Small Claim

    Hi,

    I have a debtor based in Dundalk in the Republic Of Ireland owning just under €1200 and we are based in NI. How do I go about pursuing the debt? When I rang the courts they advised me I cant issue small claims against them after leaving the EU and that I need to issue a claim notice through the district court. Would it be better to convert the debt to stg and issue proceedings through the local court in NI? Can a CCJ be transferred to the ROI once issued? Any advice appreciated., thanks

    In England & Wales you can issue Court proceedings against a defendant in the EU, but need to obtain permission of the court to serve the process out of the jurisdiction. I do not know about NI, but would be surprised if it is different. Court staff do not always give reliable advice.

    You should be able to enforce a NI judgement in the Republic.

    Have you considered engaging a debt collector in the Republic?
