  • Warrant of control - part payment received

    I received a payment to the amount of the judgment debt (the £94 fee remains unpaid) from the debtor, after the warrant of control was issued.

    I understand that I must notify the court immediately if I receive any payment. I have emailed my local county court.

    The warrant was issued by my local county court. The court claim initiated in MCOL.

    What else should I do? Do I contact the debtor for a further £94 payment?

      What deadline should I set for the debtor? The warrant was issued on 9 February, so presumably the deadline on the warrant they received is 17 February.

      If the debtor pays the remaining £94 too late that the bailiff has started their work before I can notify the court of the 2nd payment, will some additional costs be incurred (£75 compliance stage, £235 enforcement stage)?

      The least thing I want is it proceeds to next stage, unsuccessful, and I have to pay the additional bailiff costs.

            I believe not yet, no. I only paid £94 and submitted N323 form. The warrant of control was then issued on 9 February.

              I have now received the remaining £94. I have sent another email to the local county court. I tried to ring the court but the bailiff office didn’t pick up the call, and other call options transferred me to the centralised call centre. Would this really stop the enforcement?
