    Hi All,

    I only yesterday managed to get my post and found this letter from Wescott.

    I know that the debt that I accumulated will not run away and I will have to resolve it one way or another.

    I was thinking of contacting them but would apprecaite your advice please.

    Normally they say not to communicate by phone only by letter or email?

    Should I send any requests to them to see if they are definitely authorised to deal with that specific debt? Anything like CCA request to the original creditor and CPR 31.14 request to Westcott?

    Or should I just approach them by emai and try to negotiate some sort of payment plan?

    You need to delete the attachment and re-post it after covering up the account numbers and other details down the right hand side.

    In the meantime I'll summarise the content:

    -- Westcot are debt collectors and this isn't a formal Letter of Claim under the Pre-action Protocols. It's just a typical debt collectors threat letter. They say the original creditor has authorised their solicitors Drydens to issue proceedings but actually they would have to send you a formal Letter of Claim under the Pre-action Protocols [a 'PAPLOC'] before issuing proceedings.

    -- The original Creditor is Royal Bank of Scotland. The letter says Westcot are acting on their behalf so Westcot have not purchased the debt, they are instructed directly by RBS.

    -- The debt is approximately £11,000.

    Don't contact them yet wait for further advice.

    What is the debt for?

    When did you last make a re-payment?

    Was the letter sent to an address you know longer live at? When responding you do need to tell them your current address or they could issue proceedings to your old address and get a judgement against you possibly without you knowing until too late.

    I am assuming you are in England.

      Thank you Pallasathena, appreciate your advice.

      I have used iphone brush function so it scrambles the information. But I will try to delete it now and update ith with a better version.

      I do believe this debt would have been RBS credit card. I have been making regular payments until April 2024, then fell into struggles, was asking holiday payment time summer 2024, then after payment holiday time got hit by a massive bill to pay....Tried my best to carry on until start of 2025 when just could keep up with all credit payments and everything fell apart. So last re-payment would have been probably any time between January - March 2025.

      The correspondence is to my address but as I was in hospital and then away, I missed the correspondence earlier.

        Westcot's account number and the exact amount of the debt are still showing. We recommend not to show the exact amount of debt but to round it (as I have done, to £11,000 approximately).
