  • Paying for a course never used and cannot cancel

    Hi,
    Not sure if this is the correct forum or not (let me know if I can post elsewhere) so I’ll give a quick overview and can then provide any other info required.

    My son signed up for a training course to become a plumber / solar / green tech installer. At the time he was only working part time.

    Someone called to our house and sold him this course. A very short time afterwards he realised that it would not suit him nor could he afford it. He tried to cancel but was told there is no way to cancel and he would have to pay approx. £5000 the full amount of the course. He has not done or used anything in regards to the course.

    He has been paying the money every month with help from us, however he still has a year or more to go.

    I feel selling a £5000 course to someone who is working part time isn’t really fair.

    Is there anything what could be done or could I speak with some kind of claims company?

    a) You need to read the Terms and Conditions, the Terms and Conditions may be 'unfair', only a Court can decide if they are 'unfair'.

    b) What do the Terms and Conditions say about 'cancellation' rights?

    c) Send them a Subject Access Request, they have 30 days to provide all the data they hold on your son. Make sure you get Proof of Postage

    d) Contact CAB / Trading Standards, no doubt others have complained about the 'firm'.

    e) The agreement is covered under 'Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013'
    and Consumer Rights Act.

    f) You need to do some research on the firm, has there been other complaints? are there any active groups where people are trying to get their money back?

    These types of companies have form.

      Once I get this information, do you think it will be worth contacting a no win no fee type firm?
      Or is this something I will need to do

        Evaluate once you've got more information.
        We have a search facility on this website, it might be that there are posts and advice about this firm.
        We sometimes have links posted for groups you can join to see if they can help you.

          Hi, hopefully someone can advise on the below


          I have done research and these are some points

          1, company is ERR Limited (Engineering Real Results) the finance company is Caledonian consumer finance
          The policy (on letter from Caledonian) says you have 14 days to cancel, then after that you cannot cancel

          2, Google says there are reports of people being mis-sold this same course, aggressive sales tactics and not able to cancel - There are no results when searching this site for that company

          3, If I ask for a Subject Access Request, who do I send this to? Is it ERR or Caledonian? And what do I do with the info once received?

          4, (Contact CAB / Trading Standards, no doubt others have complained about the 'firm'.) - what do I say or ask of them?

          5, Is there any 'no win no fee' companies I could contact to handle this or is it something which can be done myself?? I'm not too sure on this kind of thing

          6, My son has already paid well over a year of instalments and has not used a single thing to do with the course

            From the information on the web, people have tried to cancel, but been told 'they can't', they have carry on paying 'regardless'.
            I can think of numerous reasons why someone can not continue with the course. So the 'Terms and Conditions' maybe 'unfair'.
            Course are covered under the Consumer Rights Act 2015.

            There are various complaints / experiences online, I believe there is a What's App group, can you do a What's App search.

            3, If I ask for a Subject Access Request, who do I send this to? Is it ERR or Caledonian? And what do I do with the info once received?

            Hold off doing this for the time being, you would send it to ERR.

            4, (Contact CAB / Trading Standards, no doubt others have complained about the 'firm'.) - what do I say or ask of them?

            You can lodge a complaint, call CAB, explain that you would like to lodge a complaint against ERR, you've tried to cancel the course, they won't allow you to.
            That Caledonian Consumer Finance can't offer finance 'Off-site.
            They will give you a Reference Number, they should pass it onto Trading Standards to investigate.

            To be honest, he should stop paying (I believe he might get letters, but no more then that) from what I gather Caledonian Consumer Finance can't offer finance 'Off-site', they can't come to your house and offer finance.

            How has he paid the installments?
