I very foolishly lent a "friend" a sum of money. Despite repeated promises to repay me these promises were followed by numerous excuses. In the end I issued proceedings in the small claims court and obtained judgment by default. I was considering instructing bailiffs, but discovered by accident that the debtor had died around 3 months after judgment obtained. I wrote to the debtor's family requesting the contact details of the deceased's executor. As my letter was ignored, I wrote again requesting they provide the info I had requested. Still no reply. Can someone please advise the best way I can proceed to obtain repayment. Thank you.

AFAIK deceased debtor owned property abroad, but not sure about in UK. I believe he had some assets and I'm aware he had life insurance, but don't know how much. I also understand he had an occupational pension. I keep checking the probate register, but no results show so far.

3 months may be a bit quick for probate. If it does show up, write to the executor/administrator with a copy of the judgement, making it clear that they face personal liability if they distribute the estate before settling the debt to you.Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic.
