    Im just looking for a bit of advice,

    So i have a few defaults and debts less from a few years ago which are still shown on my credit file.

    I am in the latter stages of selling my house and purchasing another one, the mortgage offer has come through but with special conditions attached to pay off the defaults.

    I have no problem with that apart form one in particular from Cabot.

    Cabot had purchased an old New Day card debt and added on a bit extra. They have 3 years ago taken me to court and failed as they couldn't provide any relevant paperwork. The claim was abandoned and they had a hefty bill for legal fees ( i used a lawyer to defend the case ) the debt they took me to court for is appx £4300, their legal fees they had to pay was £2600 ( ouch ). Now the issue i have is the mortgage company have placed a condition that all debts are to be paid off of which this is included. Iv already mentioned this to the broker and provided the evidence of the abandonment, but now my solicitor is looking for me to obtain a settlement figure from them.

    Im not entirely sure where i stand and what to do next. they havent bothered to contact me in the past 3 years since they abandoned the case.

    You may need to take this up with your lender. I say this as your solicitor will have strict instructions from the lender.

    Try to get the lender to clarify its position on this apparently unenforceable debt.

      Thank you for your advice,

      I will go back to my Lender to see where they stand. Ill be honest they have already made me jump through hoops as it is and put a large deposit down, this will be the straw that breaks the camels back if they insist on me paying it.
