  • Negotiations with debt collectors

Hello, been in debt for years, sorted myself out and no new debts for 6 years. I have two old debts taken out in 2018, two years left before they’re statuary bared. The CCJ was put on October 2020. I’ve never made a payment or made contact with a debt collection agency. They regularly send letters.

Debt comes to £1500, how do I go about negotiating with the debt agency, will they accept a lower percentage if I pay it in full? Is there a company that will do it for me. They’ve not had anything from me for 4years and will get nothing when statutory bared so maybe they might be happy to get a percentage now rather than nothing later?

I know I can wait 2years for the statue bared but i constantly worry about my car probably worth £1500 also and if the agency do decide to use more than letters they could take it. It’s the only thing they could take. It’s registered in a family members name currently so it’s safe but I would like to just clear the debts, have the car in my name and move on.

You mention statute barred but also say "The CCJ was put on October 2020" so I am not clear what is happening here. If a court has issued a CCJ on a debt it never becomes statute barred, although after 6 years the creditor can no longer enforce it without the court's permission.

    For the two 2018 debts

    - Who was the original creditor?

    - How much is owing for each debt?

    - Has the creditor taken you to court for both debts and obtained a CCJ for them? Is this the October 2020 CCJ you refer to?

    - Which debt collector is contacting you about the debts?

    - Has the debt collector bought the debt or are they chasing on behalf of the original creditor?

There's some general information on making full & final offers here. You will need to adapt it to take into account that a CCJ has already been issued.

Thank you for your reply Pallasathena

It was two credit cards from New Day. I’ve made no payments since 2018 and then in October 2020 they took me to court for one of them £900 and there’s a CCJ, no CCJ for the 2nd £600 form what I can see on all my credit files (check my file). I’ve not made contact or made payment since October 2020.

Both are now with Link. I’m not sure if they bought the debt or chasing on behalf. It doesn’t look like the amounts have had any fees added since they started chasing in 2020.

Also thank you I’ve looked the links. Am I right in thinking if I do nothing, on October 2026 it will no longer show on my credit file and I can start a new building my credit as though the debt didn’t happen?

If I negotiate a payment now and it’s marked as partially satisfied will that reset the clock and it will stay on my file for 6years from 2024?
