  • Debt Enforcement against Builder

    Hello

    We’re are looking for some advice about how to enforce a court order against a builder. He took a deposit he and then didn’t carry out the work. We managed to get an order against the builder and his son personally not just the company which has now been dissolved. Unsurprisingly they ignored this and haven’t paid. The difficulty is they have since moved to Spain and we don’t think they own any property that we can claim against. We would really appreciate any advice how to proceed without it costing us lots more money as we have lost so much already. Many thanks.

    You need to identify assets belonging to the defendants against which you can proceed. Otherwise your judgement will remain unsatisfied.

      Thank for the response. We’re aware we ca apply for an order to obtain information but would this work as they now reside in Spain. They would be very unlikely to return to attend court. Could they be compelled to provide information?
