I received a letter of claim from Kearns and I write to them saying that I believe the debt, which I did not admit liability for was statute barred. They have written back saying that an a payment of over £100 was credited in 2020 and therefore it is not statute barred. I cannot believe that I would have been in a position to have paid that amount to a debt back then. I don't know what to do considering that I only have 8 days left to respond to their original claim, which they are saying I have to do on time still. Any advice would be appreciated please. Thank you.

Hi RACH3577
Welcome to LB
Try not to worry.
What kind of debt is it? i.e. credit card, loan etc.
Send your bank a SAR, they have 30 days to provide all the data on the account for the last 6 years. Make sure you get Proof of Postage.

You might of received some forms with the Letter of Claim, fill the form in, explain that you are hoping to seek advice, but you require an extension of 45 days. Copy the form, get Proof of Postage.

Thank you for the reply. I am assuming it is from an overdraft from many years ago.
Do I send that request to Kearns or the bank themselves?
I am so grateful for your reply because I just can't imagine that I paid anything to it in 2020! Especially the amount they're saying. I wouldn't have had the money to. It is very worrying.
They did send me a form, yes. And there is an option to say I am seeking advice, also an option where I can ask for more information. Which should I tick?
Thank you so much again.

I would tick both options, no doubt they will have to go back to the creditor / bank for any relevant documents, so that might take some time.
