  • CCA- Barclaycard via PRA

    Hello,

    1st time poster here and hopeful someone can give me some advice.

    I have a Barclaycard taken out in Jan 19 that has a balance on it of over 7k. I have defaulted and it was passed to PRA to deal.

    I was making payments via a debt management plan (Payplan) for two years but decided to self manage now.

    I have requested CCA and PRA have come back quickly with a reconstituted version. It has my name on it, but an address which wasn't the one I was living at when I took the card out. It is an address I have lived at.

    What are my options here? Have they blown their chance by putting the wrong details on the CCA or can they just simply produce another with the write details on? Do I let them gonas far as a CCJ and then spring this on them?

    What's the best way to play it?

    I'm live in Scotland if that makes a difference.

    Welcome to LB

    They haven't complied with your CCA Request. I would stop payments and see what their response is, if they want to take it to Court, then it's very 'unlikely' they will get far with that 'reconstructed' copy.

    There's other prescribed terms that you need to check. Also if it does proceed to Court then you'll need to ask them for a Default Notice and Letter of Assignment.

      Thanks for the response.

      I'll have a look and see if it meets the other prescribed terms.

      If it went to court and they produced this document with the wrong address are they "onr and done"? As in theyve blown their chance or do they get a second chance with the correct address?

        Creditors can be 'dubious', Courts are 'unpredictable', creates a perfect storm. Control the things you can control.
