Hi everyone. I am in a dispute with Lowell's in regard to a debt they are trying to get me to pay. I have disputed with them and submitted questionnaire answers to my local county court. I have been sent a letter from the court, which has also been sent to Lowell's, the claimant. Lowell's need to pay a court fee by Christmas if the hearing is to go ahead. I just wondered whether anyone has experience of Lowell's actually paying the court fee and going ahead with the hearing? I have a feeling they will not pay since it is a cost borne by them and I have a feeling, as a business, they will try to avoid that. What do people think? Anybody have any similar experiences?
Any experience of Lowell's paying court fee and going ahead with the hearing?

Hello
I am in the same boat as you, I have court next February. I’ve actually seen some volunteers at the court and normally the debt agency rely on the person they are taking to court not turning up which will go against them. Don’t assume they won’t pay because they might.
I am defending the one I’m going to as they don’t have any paper work for the alleged debt that would stand in court.
don’t know what happens if they don’t go to court I guess keep sending letters I suppose
hope you get it sorted but if you do go to court - please go and defend yourself xx

What you need to do is continue as if they will proceed with the case / Hearing.
If you don't you will lose because you haven't prepared for the Hearing. Stop thinking about what they will do and won't do. You simply don't know.
Directions Questionnaire - Mediation (possibility) - Witness Statement - Hearing

echat11 is right.
You need to concentrate on things that are within your control, and to make sure that you do everything that you have/need to do.Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.
