    Hi,

    I have an old debt of 13 or so years, this has been passed onto various debt collection agencies, with the current one being Cabot.

    I have been making regular payments every month, although not a great amount. However over the last few months they have been sending me letters asking for more. I have ignored every letter.

    I got a letter saying they are going to send an agent from Orbit, however I was out. They left a calling card asking me to ring...

    Now I am going to send a CCA in a few days, but my question is can they take me to court over this? Even after 13 years? I didn't get a CCJ and the default has dropped of my credit file.

    Sorry, I got a letter and today an agent had turned up at the door.

      On what you say, you can be taken to court. The reason is that each payment you have made is an acknowledgement of the debt which under the Limitation Act 1980 resets the 6 year clock back to the beginning.

      What happened when this agent called?
      Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.
