2004 Aged Debt - Debt Collection Letter Received - and 2006 CCJ Advice

  • 2004 Aged Debt - Debt Collection Letter Received - and 2006 CCJ Advice

    I'm looking for some guidance in relation to an aged debt dating back to 2004/5.

    I defaulted on a hire purchase agreement for a vehicle due to hardship at that time. The vehicle was collected, I then had a debt collection agency and this ended up eventually going to a CCJ as I couldn't afford to make payments.

    The CCJ was in place I recall around 2006 and I have never paid anything towards the CCJ debt, not attended court, nothing.
    The CCJ came off my credit file six years later
    I'm a home owner and been in my current home for the past 8 years

    I received a letter from a debt collection Mortimor Clarke Solicitors on Behalf of MCE Portfolio Limited. The letter is very vague, only states a value, and advises they have now taken over the debt and payments, please make contact or register on their website within 30 days.

    There is no mention of what the debt is actually for, there is no mention of the previous CCJ. I believe this is a letter to establish if they have the correct person before they proceed with any further action/response.

    I know that Statute Barred cannot be applied to a CCJ, however, at least 10/11 years has passed with no contact until now. What are my possible options around time limits for collection and any advice on how i should make contact, if contact is the right approach at all?

    You can either ignore or write and ask what are they talking about.

    Regarding enforcement they have very little chance.
    As the CCJ is over 6 years old they will need permission of the court to obtain a writ of execution.
    However the general rule is a writ will not be allowed after the six-year time period unless the judgment debtor can prove that is demonstrably just to extend the six-year period

      I will not engage unless i receive another communication which provides more information or if they elude to another CCJ threat of action.
