  • pre action protocol letter for supply of water from 2012.

Hi I have received a pre action protocol letter for supply of water from 2012.

I want to settle this debt but am I responsible for the debt for all 11 years or is all but 6 years time barred?

I believe the backdated bills are subject to the 6 year limitation period.

Sorry forgot to state that I'm a commercial customer. Should I just pay the last 6 years bills? Thanks Rob for your reply.

Make it clear that is what you are doing and that by virtue of the Limitation Act 1980 they are not entitled to pursue a claim for debts that are more than 6 years overdue.

If you do not do this you risk any payment being applied to clear the oldest debts, leaving a claim for the more recent ones.
