    Hello to all. I am Mr turnips. I am writing on behalf of my partner.
    she has recently received a letter from TM legal services acting on behalf of perch capital in relation to a lending stream payday loan she acquired in 2018.
    At the time the loan was taken out my partner had come out of a debt relief order only 6 or 7 months before. A note of which was still visible on her credit file. Also my partner had shown no evidence of ever paying back any previous payday loans. Most of these were taken out as a result of mental health problems and also linked to gambling.
    We raised a complaint with lending stream stating irresponsible lending which they acknowledged but then didn't receive any further update in relation to this.
    ​my partner has recently lost her job and now has no realistic way of paying back the money owed. She contacted TM legal services today to explain this and also inform them of the history of the case. I told my partner to tell TM legal that I would be happy to make a payment to settle the account as a goodwill gesture which amounted to nearly a quarter of the original debt. They refused and asked us to contact lending stream regarding the investigation into irresponsible lending.
    we are waiting to hear back from lending stream now.
    Basically could anyone help with a way forward and what we should do next.

      Loans aren't my bag but I would suggest that you hang on (and chase up if necessary) the response from Lending Stream and if you're still unhappy go the the Financial Ombudsman Service.

        To lodge a complaint with the FOS you'll need a final response from Lending Stream, if they don't respond and 8 weeks has passed you can go ahead and make your complaint without the need for a final response.

          Just for ref you don't necessarily need to have made a formal complaint before you can go to FOS, if you have already made a clear expression of dissatisfaction. I did this on behalf of someone and FOS didn't agree initially but I sent them the below from FCA and they changed their mind!

            Agree you can lodge a complaint at anytime, the FOS's states the Final Response Letter / 8 weeks without in all their literature etc. The problem is that they won't start looking / investigating the case until they get the Final Response Letter / 8 weeks (the business can't say they weren't given an opportunity to look into the compliant).
