  • Direct Debit Agreement help please?

    Hi, I would like some advise please?

    I instructed the bank to pay a bill by direct debit each month. When you have "x" amount of money coming in the bank will give you a reward (per month)

    I was always in receipt of getting a reward every month but one month the bank did not give me a reward.

    I contacted the bank and they said I had not met the criteria because they had paid 2 months payments out the following month. The bank will not give me the money back.

    Where do I stand on this please, I feel I have fulfilled my contractual agreement under the Direct Debit Agreement. Can anybody advise me further?

      I complained to the bank and they declined the payment. It was £5 a month

        Email the bank, set out your position, tell them you want a final response / deadlock letter if they can't accommodate your request i.e. the '£5 a month'.

        Explain that you will lodge a complaint with the FOS if the matter isn't resolved.

          I lodged a complaint and the bank and I received a final letter with the FOS details. I did complain to the FOS but I never heard back from them. I am wondered where I stood legally on this? Since I have no control over the direct debit system I am wondering if the bank has breached any contractual terms by refusing to pay based on the direct debit date problem?

            The incentive the bank offers will have it's own set of T's and C's. No doubt they have your scenario covered. You need to chase the FOS who don't always look at T's and C's,

              I have been in touch with FOS and as far as they can see the bank is not at fault. I can not control the direct debits but it is a requirement from the bank for this deal that I have two direct debit payments each month. They are requiring a criteria that I am not in control of. I have instructed for two direct debit payments to be made in accordance to their terms and conditions. The bank refuses to pay the bonus because the direct debit did not come out as instructed. From what I can understand, even though I am not in control of the direct debit system, I am not entailed to my bonus because of their choosing of payment times. I would like to know if I have any legal right to claim my bonus because the criteria set by the bank is something that I cannot control. In other words are the banks terms "unfair" and therefore, the contract I am in to receive my bonus falls under 'unfair terms and conditions'?

                It sounds 'unfair', as pointed out by you they select payment times. Have you gone through the T's and C's for bonus scheme.

                  Aren't direct debit payments requested from your bank by the payee? The bank doesn't "decide" when to pay them - you've given the bank authority to make the payment(s) when your creditor requests them. I think it's the person or company requesting the payment you should be complaining to as they must have changed the date of the debit. Ask them. (Not that you've got any grounds for complaint as they will probably have notified you of the date change in advance - unless they took the payment in the wrong month by mistake)
