  • FOS Obudsman final decision IGNORED

    Elderbridge had 28 days to pay me £300 and make an adjustment on my balance. This was the final legally binding decision by FOS .28 days is up Elderbridge have ignored it. What do I do now? Gratefull for any input .I am disgusted yet not surprised Elderbridge have ignored given they think they are above the law.

    Just to add I have a further two cases with Obudsman FOS re Elderbridge but was assured had no bearing on response deadline for this case.

        Thanks Des8 .Really they should've fined for ignoring decision and pay me for additional stress. Given Elderbridges record small claims court may be the route.

          Just an update .. Elderbridge paid the £300 but have not bothered to tell me found out from bank.They have not adjusted balance and simple interest as per FOS and therefore missed deadline of final decision 14.11.19 and were not in touch as per FOS to tell me so Elderbridge have failed FOS decision. Have said Elderbridge are erm working on it.Really so FOS set deadline but Llow Elderbridge to miss and in effect give them carts balance.Still have two open cases with FOS re Elderbridge .Disgusted with pair of them.Have new complaint with Elderbridge now adding interest on zero areasÂ* that FOS previously told them to refund and stop .. well they started again.. Elderbridge have ignored complaint.WHY ARE Elderbridge getting away with so many regulation fails ??

            Clarification FOS say Elderbridge Re working on it..passed FOS decision and that's ok with FOS. Hence disgust

              I am not a fan of the ombudsman service anyway: not the way they work (basis of what is fair, not necessarily according to the law) and then can't or won't enforce decisions.

                Farce Elderbridge have failed deadline .. FOS still looking into sorry they ignored missed final decision joke other way round I would charged interest admin interest upon interest so company can ignore* final obudsman* decision ok with FOS REALLY?????

                  If you aren't happy with how long they've taken, threaten to issue a claim and enforce the decision along with further costs against Elderbridge.Your coming up to circa 3 months now and assuming no reasonable excuse has been given to make the necessary adjustments, it sounds like they are delaying. Clearly seem to be no motivation from them and they've been given multiple chances, so you either carry on waiting around or take the necessary steps to make it a court order.

                  A letter before action giving them 14 days to comply should be sufficient and if they don't, follow it through.

                    So Elderbridge no clarification on why they did not refund DD as per* fos decision finally they adjusted balance but then added interest charges fos closed case and opened a new one five years ongoing farce they know I cannot afford a legal case and this is beyond a joke

                      In N.Ireland laws slightly different does anyone know costs procedure of raising a legal case re Elderbridge and GE money GE advised me to miss payments told me I was up to date* a lot to it but fos dismissed GE and went with Elderbridge as case originally ...*
