  • DRO unenforceable debts

    Hi all.

    if a debt has been clarified as being unenforceable does it have to be included in a DRO application.

    "Whether or not a debt is unenforceable is only an issue in DROs if inclusion of that debt would take the applicant over the £15,000 total debt limit. If it wouldn't, then it should be included in the DRO regardless so that the applicant can have the certainty of being released from any possible liability at the end of the moratorium period."

    However if the applicant can show the debt is unenforceable I understand it is his choice, but if he is mistaken.......
