Can you outline what you mean by Arrows 'reconstituting' the T&Cs?

If they haven't got a scanned copy of the original document but they have enough known facts from the original creditor to produce a "this is what it would have looked like" document then that would be a reconstituted document.

However it has to be 'honest and accurate' and they would have to satisfy the court that those Ts & Cs were there when your partner signed that form etc etc.

That's a rather basic description of a reconstituted document, but you get the general idea (I hope).

Arrow has told you that Restons are managing the account so I expect they will write to your partner next.

If they are contemplating a county court claim then under the new Pre Action Protocol they should send her a 'Letter Before Claim' and then not issue legal proceedings for at least 30 days which will give your partner time to consider the situation.

One question which I should ask is whether your partner ever had any other financial products with HSBC apart from the credit card?

Did she have a current account and/or loan etc because HSBC have a habit of combining accounts before selling them which can give them a problem later down the line?

Many thanks. In answer to the last paragraph, yes my partner had a current account with HSBC (since closed).
