          Just seeking a bit of clarification from all you learned lovely people, I am repaying my debt to Castlebridge DCA at £25.00 a month I borrowed £400 (from a Payday Loan Co) am I right in thinking that I should repay the £400 plus a months interest (£100)?

            Quick question on this thread - how much is the content is still valid after the 2009 Carey v HSBC case and current OFT guidelines?

            I note for example a "true" copy of an agreement as a result of 77/78 request DOES NOT now be required to be an actual signed copy but merely a reproduced copy of what you would have signed...

            Is there a later thread I should be reading?

            I am currently facing a bankruptcy petition hearing containing alleged debts I have no knowledge...

              I believe for the sake of a court hearing a true signed copy is still needed. For a CCA s77/78 request a reconstituted copy is acceptable, but not for court. I stand, of course, to be corrected, but that is my understanding.

              The Carey case did change things without a doubt, but there is the issue of whether you are the defendant or claimant.

                hi had a letter from credit security lts

                marks and spencer £477


                i wrote to them that i do not recognise the above debt

                they have stated in order to clarify the the position for our client to forward a copy credit agreement and statement would ask you to forward a fee for the sum of one pound

                i have had my credit file and no debt is recorded against me thanks paul

                  Do you owe any money to Marks and Sparks, or does anyone in your family?

                  If not, then either tell them to get bent, or ask them if they understand that they have suggested you should obtain personal data of someone else and thereby contravene the Data Protection Act 1998.

                    Just wanted to say that the letters provided here were amazing! I had absolutely no idea about the legal loopholes that DCA's try to avoid, and it certainly explains a few of my experiences! Fantastic thread and clearly a lot of work went into it.

                      They are a little old, but generally sound.
                      Also we don't deal in "loopholes" but actual statute law, sorry personal bugbear of mine..

                      DCA's should always be put to strict proof that the debt they claim is owed is lawfully acquired and valid.

                          Hello there

                          Do you have any experience with regards Full and Final settlemetns.

                          I have been offered a lump sum to settle my unsecured debts but this amounts to about 20% of toatl sum owed.

                          Is it worth me offering this sum and what are the chances of them accepting it.
