  • Restons / Arrow Global saying CCA request is invalid & threatening legal action

    Hello,

Having previously had some excellent help on this site, I hope you can help again.

I received correspondence from Restons Solicitors in February asking me to complete an income / expenditure form so as to repay a debt. On the letter, there was no detail of the creditor / amount owed etc. I wrote back to Restons asking for details of the debt and at the same time sent a CCA request to them.

Restons response was to decline the CCA as they were not the creditor. They did, however, advise their client was Arrow Global and the debt originated from a HSBC Credit Card, for which the account was opened back in 2006 and defaulted in 2011. I therefore sent a CCA request to Arrow Global (and requested the notice of assignment) while making it clear I do not recognise this debt.

Today I've received the following from Restons:

"Our client has forwarded your request back to us as it is invalid.

We now require your proposals for repayment via the attached financial statement no later than 24 May 2016. Should there be no response by this time, we may be instructed to issue legal proceedings."

Is Restons just bluffing - how is a CCA request invalid? I (like everyone I guess) really could do without having to defend a court claim - which I trust I can do without the credit agreement being provided? Can you advise the best way for me to respond to Restons please?

    Thank you
