Robinson Way coming after me for a Santander Debt from 2010, what are my options?

      CCA yes definitely but expect to be messed around send it to RW use a £1 postal order marked " For Statutory Fee Only " on both sides copy the PO and keep for your record.

      RW/HPH are playing around saying that they don't require the fee and then allocating it to the account thus affecting the 6 year limitation period.
      Use signed for post check delivery date and signature and print a copy for your records.

        A SAR request isn't the same as a CCA (CCA's are not applicable for overdrafts unfortunately) . SARs (a request for everything related to the account/you) cost £10 and CCAs (a request for the signed agreement) cost £1, so there's a bit more money involved, but you should get some answers xx
        Debt is like any other trap, easy enough to get into, but hard enough to get out of.

          • Send a SAR request to Santander, £10 charge - Info related to me and my old account
          • Send a CCA to Robinson Way, £1 charge, for proof and confirmation of this debt
          • Depending on the outcome of both, follow up with saying its now statute barred?

              Was the Overdraft arranged or unarranged. Santander have been known to keep accounts open for a while before defaulting . As overdrafts are usually set for a fixed period if you stayed within it then they would wait and possibly even auto renew. I know its naughty but they do

                Ok that's interesting, and makes sense. I guess it was arranged (£1500, the rest must be interest).

                    If you're sending an SAR request ... it would be better to send it to the Original Creditor (RW are not likely to hold a lot of info regarding the account ) xx

                          How do I access the PM you sent to me a couple of days ago about my I&E. I've just found the original I&E compiled by Compass and it is a farce- it is missing sizeable rental income and there are countless errors in the expenditure showing my disposable income as about £90 per month!!! Strange - Dishonest, etc.
                          Clearly this was used to gain low token payments but it would have borne no resemblance to my interim updated I&E sent late 2015. That showed a disposable income of nearer £400 before Compass' £300 fee.

                              Thanks for that but I'm tying to find Ame's PM to me with the blank I&E form for me to complete - just can't seem to get into my old PMs. I'm happy to forward that to you once complete - doing a regular I&E is a daunting and quite worrying process, particularly as I have just received my car insurance renewal and the breakdown cover renewal; the latter has almost doubled this year so phoning around. Also cancelled a Kirby vacuum guarantee/service contract (getting a FREE Kirby service tomorrow from another company - but suspicious as to how 'free' is free?) And just had a boiler/service/guarantee renewal which has also gone up 20%. So having to redo my I&E. It's been a bad week on the expenditure side.

                                if its a Santander debt first look for who has employed r/w to collect it for them

                                find out who owns the debt it wont be r/w who owns
                                p/m me the details if it has been sold as to who signed the assignment for santander and when
