  • Welcome Finance and Lowell Finance

I'll try to be short with this but give you the jist of what is happening.
I bought a car in the 1980s which was financed by Welcome Finance, Total bill was around £10,000
I never missed a payment and though I paid way over the price for the car, I had no problems.

About 8 or 9 years ago I received a letter from Welcome to say they have sold my account to another finance company, and this company would be in contact within 14 days.
No contact was received, tried phoning the number I had for Welcome, the phone was no longer in existence, I emailed them,, no reply, so thought if they want the money (£273.82p ) they would contact me.

I received a letter 2 weeks ago from Lowell Finance demanding £7,042.95p for my non payment on my Welcome Finance account.
I phoned them on a premium number and was told that they now held the account and payments must be paid to them.
I stated that I hold no contracts under the name Lowell Finance and will definitely not pay over £7,000 for a bill under £300.
They tried to say that this was an accrued non payment and interest rates over the years of non payments, They said if a payment is not received they will take me to court and have bailiffs take goods to the value of the debt,, I told them to take me to court and hung up on them.
Am I due this money to Lowells or have they just bought the contract from Welcome.

Oh yes at least 8 years ago.
All I really want to know is, do I owe this money to Lowells, and can they charge over 7 grand for a bill under 300

They can take me to court I have no problems with that, I have never defaulted on any payments until I received the letter stating my account was sold to a finance company (not a debt agency)

        Hello shewbert.

This is not going to court the debt is statute barred under the provisions of the Limitation Act 1980, so cannot be enforced by the court.

Please keep off the phone with Lowell their telephone jocks are useless company script quoting nobodies.

I suggest a letter to Andrew Bartle COO the Lowell Group informing hime
that the alleged debt is statute barred and you will not be paying.

This has to be in writing to formally stop them contacting you again.
In this case I suspect Lowell is aware of the status of the debt and are
taking a chance that you don't.

Thanks ever so much, these Lowell guys certainly put the pressure on, I have ignored 4 telephone calls today alone, suppose it's my fault for phoning them and not hiding my number.
Will write to them with a registered/signed for letter so they can not state they did not receive it.
You have put my mind at ease
          Ray
