    Hi all
    I started a thread on here a while ago about Lloyds passing me to Wescot even though I had paid a set amount for about 5 years now.
    I sent off a CCA request to Wescot who have passed it on to Lloyds.

    The funny thing is they say I have not provided a valid 16 digit account number they need all my addresses i have lived at, change of name, date of birth and date account opened.

    It states at the bottom of the letter that section 78 only applies during the lifetime of the agreement if my account has been closed and paid in full then there would no longer be a regulated agreement between me and them. In view of the above we are unable to provide you with documentation as requested.

    Has anyone got any Idea what Lloyds are up to I think it seems as they have no documentation but are not fully admitting to it what should I do now I have been at my current address for nearly 10 years and the account ref I gave for the CCA request was the one I have been using whilst paying a reduced amount with frozen interest

    Yes, they'd need to go back to the orginal creditor as Wescot wouldn't have any paperwork.

    That is true, s.78 only applies to accounts where there is an outstanding balance. If the debt was paid in full they have no duty to supply a copy of the agreement.

    Has the balance been paid off? if it has, see above. Have you been paying Lloyds directly? Wescot are just a debt collector these days but I think at some point they used to buy debts as well.

    If they are saying your account has been paid in full I'd keep that letter in a safe place.

    You may consider sending a SAR to Lloyds, the duty to respond to a SAR does not end when the account is closed and paid in full. It will cost you £10 and they have 40 days to respond.

      This is a SAR letter I've used a few times:

      Dear Sirs

      Ref: xxxxxxxx

      Subject Access Request - S.7 Data Protection Act 1998


      Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or printouts of all account transactions; all internal and external correspondence sent or received by you including memos, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on all types of media in any relevant filing system. If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

      If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form.

      Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge. I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

      Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

      I enclose the statutory maximum fee of £10.00 to access ALL data held by you about myself. You have 40 days in which to comply with this request.

        No I have not paid it off but cant understand why they want me to provide all the info is it normal I have had letters from Lloyds about the transfer to Wescot so they do know who I am any ideas has to waht I should do next

          It all depends on what you want to achieve. When did you take out the Lloyds card?

            All I was trying to do was get hold of a CCA if LLoyds have one on my previous thread I was advised to ask for one to stop Wecott pestering

              This happens not to frequently but it does happen, usually because debts are sold with the absolute minimum of data, just debtors name address and other contact details if available these details are often so vague that there is difficulty in making sure the correct information
              is supplied with CCA requests and SAR's.

                But Lloyds only asked Wescot to collect the credit card has always been with LLoyds it has never been passed on in the last 5 1/2 years Im now really confused has to mynext best move why would they want all that Info is it not up to the creditor to find the info

                  Sorry, do you mean that Wescot were only agents for Lloyds?
                  In cases where a DCA is only involved with collection of management of a debt ( especially Wescot which is renowned for prevarication) I've found it's often far better to communicate with the original creditor, sometimes stating that their " agent" is uncooperative.

                    Yes I sent the original CCA request to Wescot who are only agents (confirmed by Lloyds) they passed it Lloyds who have asked me to supply my full name and address and previous addresses date of birth any other name i may of had and what date I opened the account , thats why Im asking for advice shouldnt Lloyds have all this info or is it because they have no record of my CCA im very suspicious and confused all at the same time

                      Ahhh I understand now I think, with all the mess Lloyds/ TSB et al merging splitting up again and different data controll systems shared by the banks involved and the fact that Lloyds were always a bit "sloppy" with paperwork and I believe some account renumbering occurred in the past verification is/was more than a little difficult.

                          Yes it can do no harm I guess some cross checking is needed.

                            If I remember correctly, Wescot used to be both debt collectors and debt purchasers (buying debts) but these days they act only as debt collectors, I guess all the debts they bought in the past would have been sold on but it looks like Lloyds were only using them as a DCA. I also had dealings with them back in 2011, they sent lots of bright, red letters but eventually gave up the ghost when I told them RBS had not sent something compliant in response to my CCA request, they told me to send £1 and a CCA request! DOH! I had been there, done that and that was the last I ever heard from them.

                            Yes, Lloyds should have all that info but it looks like they think your account was closed and paid off, which wouldn't be the case even if they had actually sold it, they may have been looking at the wrong account, however, if they can't provide you with a response to your CCA request, then the account would be unenforceable! :grin: :grin: :grin:
