  • Lowell - British Credit Trust

    Hi all,

    I fell into debt with British Credit Trust car finance after losing my job. I informed them I wouldn't be able to keep up the repayments on the finance and asked them to collect the car, in which they did. Obviously I was aware that I still had a debt with BCT and started paying them £50 a month to pay off the remaining debt (£5587.27).

    After a few months I got letter to say they had sold my debt to Lowell. After numerous letters, I didn't reply to any of them, I have now had a "Pre-Legal Assessment" letter from Lowell threatening court action and CCJ.

    On my credit file that debt is showing as satisfied. Can somebody please advise me on what I should be doing next please?

    The default date on my file is 30/03/2010..

      Hi,

      Thanks for the reply.

      The payments stopped when Lowell bought the debt.
      I was made redundant in December 2014 so currently not working no.

        Hi Welcome,
        The " satisfied " entry on the credit files shows that Lowell have BCT for the debt.
        Please tell the time scale, when was the start? When was the last payment made? When was the car collected?

          Hi nemesis

          The details I think you are asking are as follows:

          Account start date
          06/08/2007

          Account end date
          30/03/2010

          The car was returned in about October/November 2012, with my last payment to BCT roughly around June last year. That is when I had a letter from Lowell stating they had bought the debt from BCT. I have had no contact with Lowell up to the present time.

            Ok we have Lowell with a debt of what value exactly.
            You should be aware that Lowell is prone to issue Statutory Demands or Payment (SD's) on debts of medium to high values.
            Lowell are currently not pressing for payment on this which is surprising.

            I suggest that you make a Subject Access Request under the Data Protection Act 1998 to get all the personal data that BCT holds on the account and you.
            Some BCT paperwork I've seen in the past has been quite suspect.

            There is a £10 statutory fee to pay ( use a cheque or postal order ( Clearly endorsed " For Statutory Fee Only" keep a photo copy of the endorsed item.)

            Address to the Data Controller at BCT: Use signed for post.
            You will then perhaps steal a march on Lowell if they start to press for payment.

              The debt is for £5587.27, it was originally just over £4k but various charges have been put on the debt.
              Lowell sent me a letter a couple of weeks ago offering a discount (£3680), obviously I am in no financial situation to pay that amount off.

              Is there a draft letter on here for the SAR?

                I have just been on the BCT website and it appears they have been bought out by Capquest. Will this effect the SAR?

                  The Data Controller should still be able to provide all the data.
                  Just make sure all details are correct, name and address when the account was opened, any changes of address and account number.

                    Yes a very quiet buy out.
                    Have to wonder how Capquest will run this, it's debt collection activities are often "heavy handed".

                        I found it odd that a "finance" company are now owned by a what is in a nut shell a DCA.
