  • Capquest advice needed.

    Hi,

    Years ago i got into quite a bit of debt (7-8 years ago) due to personal circumstances, i have been slowly paying it back and now have a spotless credit history etc ... however recently i applied for a mortgage which was fine. However during sale of our property it transpires that there is a charging order registered against it due a CCJ from 2007. The CCJ and subsequent charging order was registered by Capquest who have NEVER been in contact regarding this debt in over six years. I have never entered into any payment arrangement with them, however i did have another debt with them that I mistakenly thought was this CCJ and have settled this in the past year.

    Now after talking to them they have sent me a letter saying that i need to pay around 7K to settle this debt confusingly they have also written to my solicitors telling them that i need to pay around 11.5K and that they will be charging interest @ £1.66 per day, i am assuming the additional amount is interest for 6 years.

    I am not trying to get out of what I owe and need a speedy resolution to this given the property transaction i am about to make (in about 30 days) need to get this resolved. I am basically looking for advice on how to proceed given the different amounts quoted and also whether there is anything i should be doing here ...

    Update on this and a further request for advice.

    I have spoken to Capquest again and have offered to make an immediate settement of the amount they quoted me originally £7.5K , they after much discussion have declined this and are still seeking 11K on a 6K orginal debt.

    I thought i was being pretty fair and even the girl who was speaking with the legal team seemed to be quite surprised by their hard line.

    So to recap , I have had no comms from Capquest for over six years and now they are attempting to back date interest of 8% totally at odds to the first letter they sent. They have never sent me a statement or any form of communication. I have also learned that althrough they say they have a charging order they actually only have a restriction as the property is in joint names.

    Does anybody have any idea of what strategy i should take here, or do i have just have to pay the original amount plus what is nearly 100% in interest charges. Is there any legal redress here ?

      Hi,
      Do you have this letter offering a £7.5K settlement ?
      So we have a CCJ from 2007 which you have never paid in regard to the judgement?
      No contact or attempts to enforce the judgement from Capquest?
      Is there any threat of enforcement from Capquest.
      Was the offer made under a time limit?

      The CEO of Crapquest is Mark Brunault I believe , my feeling would be to make a complaint directly to him regarding the company refusing to acknowledging the offer it has made.

        yes i have a letter sent on 19th Dec stating the amount and then another letter sent the same day to my solictors with a different amount.

        the debt i was paying and have paid off and the debt this CCJ was issued for were owed to the same company hence the confusion , i genuinely thought I was paying off what I was supposed to pay. I would never have let all this interest accrue or not enter into a payment arrangement had i known this was outstanding. You can imagine my surprise when i settled the debt and asked them to remove the restriction and then they said oh it is not for this account we have another account which we have never contacted you about, i wish i had been recording that call.

        No time limit on letter that I recieved , just a confirmation of amount owed and the original company.

        Also no follow up since they got the restriction on the property which would have been over 6 years ago , and no statement of account or any indication of accuring interest on this account.

          CEO of crapquest has changed now looking at the interwebs. There is a lot of confusion around restrictions online and also the legality of interest on a CO. What i really need is some specific cases to quote back at them. I do not have a copy of the original CCJ I am afraid though. Is there no legal obligation for them to provide me with some kind of statement ? is it legal for them to charge interest on a consumer credit debt like this ? Can i go back and have the restriction lifted if i pay the amount on the original letter, suppose i had , would they have come back for more. Does the restriction apply to the orignal CCJ amount , they can sing for the interest if i can detach the two legally. I do not have a huge window of time to sort this out (3 weeks max) so any help would be really appreciated.
