    Hi All,

    I have received a letter before claim from control account dated 13th October. They have given me 14 days to respond though the letter has only arrived this Friday that is 24th October. I seriously doubt Royal Mail would have held the letter for 11 days before the delivery was made.

    Control account are representing FedEx and the fee for the alleged delivery.

    Everything has started in May 2014. We were supposed to get a delivery from China. FedEx as per normal practice have delivered two parcels and week after that invoices have followed. Two invoices were for both boxes and custom fee they have encountered. In July however I have received a letter from control account requesting to pay outstanding debt to FedEx for the delivery in May. Having contacted FedEx I was advised this was for the third parcel that was never received by us. Having contacted our suppliers I found out that indeed it was supposed to be three boxes and not two. I have contacted FedEx and raised a lost item case. Few days later I have received a voicemail from FedEx advising that they are looking into it. Their system shows that three parcels were delivered however they will do their investigation to the end.

    Come August I have yet again received a letter from control account asking to pay the money. Contacted FedEx and was advised that my case was closed! According to them the agent left a voicemail message with his findings and because we have not responded they thought we are satisfied with their investigation results! Bloody cheek!

    So another investigation was darted in August. Customer advisor agreed that something is not right as there are no signatures for the parcels received which is not correct way of FedEx. She confirmed me the name of the manager who will investigate and gave me the direct number. The following week was cat and mouse game. I would call the number and no one would answer. I would leave a voicemail message with the required details and would ask for a call back. I did however advise them that I am on night shift and will be sleeping during the day so would appreciate a call either morning hours or late afternoon. They would deliberately call me between 12:00 - 16:00 and would leave a voicemail message. I went on holidays end of August and received no further comms from FedEx.

    What is interesting that during that period the tracking numbers on the system suddenly started showing a different story. Whilst in the past the master tracking number would show three parcels delivered now it would show only two delivered parcels with a third one not on the system....

    Come September I contacted FedEx again asking the status and was advised that case was closed! Apparently they could not get through to us and therefore the case was closed. I asked to re-open again and was told someone will contact me in two-three days time. No one has contacted me and I have received no further communication from FedEx. I was actually in the progress of taking this into written communication only to receive a letter before claim from control account regarding the ''outstanding debt'' for something that was lost by FedEx.

    I also realise the time is not on my side now. I imagine it would be hard to prove that letter was received only 24th October....

    I attach the letter and would appreciate advices on best response.

    I was thinking of sending two letters to both FedEx and control account and asking how the court action was thought off when I have received no written confirmation from FedEx regarding my lost delivery.

    Personally, I would contact Fedex again and put in a formal complaint about how they have handled your dispute. Outline all the problems you have had up to now, and insist that they now rectify this. A complaint to Fedex can be made through one of the links on THIS PAGE

    At the same time, you should (IMO) contact controlaccount plc and advise THEM that the account is in dispute with Fedex.

      Thank you Kati for such a quick and informative response. I am going to create couple of drafts in the meantime and will probably upload later before they are being sent.

      That should hopefully start some chain reaction and would receive a reasonable response from FedEx rather than a bullying ignorance one...
