  • Letter from Westcot

    Met a friend today who showed me the latest letter from Wescot a letter sent looking like a payslip many get sent in the post?
    Inside it asks them to phone a number below it it the smallest print I have seen it states its from a DCA my friend is not stupid or gullible but to some this would worry them enough to phone and quote the reference number.
    Can they stoop any lower This debt is SB as the last payment was made from a DMP over seven years ago

    Sadly it looks like they can't wales01man ... It's bad enough when they chase valid debts, but to scrape the barrel like this is just disgusting! Not everyone knows about debts being SBd after 6 years - and to dupe people into phoning them like they do should be cause for complaint.
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

    It doesn't matter where your journey begins, so long as you begin it...

      Because of Me being on here I can tell my friends what the rules are and the Laws regarding Debts before LB I knew very little if only EVERYONE could gain the knowledge that AMETHYST and many others offer

            I haven't even had a threatogram ... unless you can count my Rossendales Notice of Enforcement that came to nothing (for them) anyway :lol:

                hahaha :lol:

                I'm sure if I ever opened any of the letters addressed to the ex-tenant of my house they'd nearly ALL be threatograms :sad: - I've spent all year sending them 'return to sender' (apart from one that was posted from just up the road - that got handed in)

                  I hate to stick up for them, but once a debt goes SB, unless you live in Scotland where the debt is actually extinguished, in the rest of the UK the money always remains outstanding, it's just they cannot lawfully enforce it under statute.

                  That doesn't mean they can't ask for the money, it means you can tell them where to go in polite terms with the SB letter if they do. Once the SB letter has been sent, they should stop hassling you.

                          The main problem is that they can still issue court paper for SBd debts. OK so you can defend the claim and SBd is an absolute defence, HOWEVER, people don't always receive the court papers. For example, they can send them to an old address you've not lived in for 10 years. Next thing you know there's a CCJ on your credit file and you have to go through the motions of applying for set aside.

                          Not everyone is aware that debts go SBd after 6 years, some may see the court papers, remember the debt and put forward an admission.

                            Well, I once saw an official CCCS rep (before it was rebranded Stepchange) on another site telling the OP they would help them set up a repayment plan for their OH's SBd debt because "the debt still exists and is due and payable". With advice like that... :der::Cry::Cry::Cry:

                            Would be interesting to see what CAB, etc. would have to say, maybe we should start a little undercover test on the subject!

                              I think with CAB it would depend a lot on the adviser you were lucky / unlucky enough to get; as we know their advice varies tremendously from branch to branch.
