  • Robinson Way Debt Collectors - lowlight

    Hi ppl

    I wondered if anyone could help with my situation...

    A few weeks ago i received a letter from Robinson Way stating that they had been trying to contact me about a previous address i lived in ( it was an address i lived in for less than a year when i was a student 2004-2005). The letter didn't state anything else other than to ring them. After going online and searching to see who or what Robinson Way are, I then realised it was probably to do with a credit card I had at the time and once i left that address I forgot to keep up with payments.

    So i didn't ring but instead decided to get a statutory credit report. I done this because i'm still with the bank I got the credit card from and they have never asked about the credit card, in fact they offered me one on several occasions.

    So the credit report came back and there is no mention of any debt owed to anyone. So I let it go and still didn't ring Robinson Way.
    I now a couple of days ago received another letter from Robinson Way to say that i owe a sum of money to the bank. I still haven't rang but they now have rang my land line number looking to talk.

    My question is this debt now statute barred?

    Any advise will be greatly appreciated.

    Have you any idea when you last made a payment (or acknowledged the debt in any way)??
    Could you possibly post up copies (with personal details removed) of any letters you have received??
    Was the latest letter received a 'letter before action'??

      That's a little strange because normally banks would offset against any money you have with them, for example if you default on your credit card but have a current account or a savings account with the same bank, they can use their right of set-off to take money from your account to pay the outstanding balance.

      Is it possible that you had another credit card apart from this one?

      Defaults drop off 6 years after they are recorded, if this was from 9 or 10 years ago as you say above it shouldn't show up.

      Good thinking! :clap2: You shouldn't ring debt collectors under any circumstances, keep it all in writing. :typing:

      It would be if you haven't made any payments or written acknowledgment in the past 6 years. Some people default then make payments so the debts do not become SBd even when defaults have dropped off.

      You could either send a prove it letter if you're not sure what they're on about or a SBd letter if you think it refers to an account that may be SBd. :thumb:

        Hi Kati and FlamingParrot, thanks for the replies!

        So to answer Kati first, the last payment i would have made would have been around May-June 2005,after this I didn't change my details to my new address, I have attached the two letters that were sent to me.

        In response to FlamingParrot, no I've had no other credit cards, and also find it strange that the bank did not with their own records try to contact me themselves.

        Sorry to bother you again but do you have an example of a SBd letter that I can send to Robinson Way??

This is stated in s5 Limitation Act 1980, and any court claim will be defended on this basis.

          If you have evidence that this debt isn't statute barred then please send it to me within 21 days.

          The Financial Conduct Authority state in CONC 7.15 that a firm must not attempt to recover a statute barred debt where they havent been in contact with the customer during the relevant period.And that a firm must stop demanding payments to a statute barred debt where the customer has stated they won’t be paying it.
