Got a letter from Robinson Way today

Now, I did live at the previous address they have included (I left in mid2010 after living there for 9 years) but I cannot recall any outstanding debts in my name. At the time, I had a PAYG mobile phone, a PAYG internet dongle, the electric was on a payment meter, there was no landline, no gas supply, I had no catalogues or subscriptions etc.... and the rent and water rates were in my ex partner's name. There is nothing I can think of that would mean I owe anyone anything..

So do I just ignore it??

Yes, looks like a big stinky barrel of "phish". AKA random tracing letter that may be nothing to do with you.

Unless they (a) write properly giving details of what they are after, (b) put something nasty on your credit files, or (c) breach pre-action protocols by skipping straight to a claim, then personally I would ignore.

Thanks [MENTION=1508]Nibbler[/MENTION] I thought it might just be a fishing trip .... Even if there was a debt, it couldn't be from that address as I was getting CTC in a post office account (no DD or overdraft facility on it) and had no subscriptions or catalogues etc :tinysmile_grin_t:. And I was there for 9 years :lol: so if I owed anything from before I lived there it would be definitely SB

In that case then I would just keep an eye on your credit file to make sure they don't slap anything nasty on it by incorrectly linking whatever they are chasing to you. Seen a few cases of that happening - for example where new residents at people's old address have taken out credit in the previous tenant or owners name, then done a bunk.

Probably unlikely, but best to keep an eye on your credit files just in case, as something like that could be more recent and show.

What do I do now?? I know that I have never had an account with shopacheck (I had a provident loan some 12 years ago - that was paid off via my sister after I had moved house and couldn't pay the lady myself).

Do I still ignore it??
Or do I send them a 'prove it' letter??

I would point out that I have no knowledge of any such debt being owed to HPH LTD. I am familiar with the Consumer Credit sourcebook of the Financial Conduct Authority (FCA) which states the following rules.

"A firm must not ignore or disregard a customer's claim that a debt has been settled or is disputed and must not continue to make demands for payment without providing clear justification and/or evidence as to why the customer's claim is not valid." 7.5.3

"A firm must suspend any steps it takes or its agent takes in the recovery of a debt from a customer where the customer disputes the debt on valid grounds or what may be valid grounds." 7.14.1

"Where a customer disputes a debt on valid grounds or what may be valid grounds, the firm must investigate the dispute and provide details of the debt to the customer in a timely manner." 7.14.3


I would ask that no further contact be made concerning the above accounts unless you can provide evidence as to my liability for the debt in question.

Well, technically if you have never had the account in question then you have no right to make a CCA request regarding it. Plus a lot of debt collectors just assume that if you make a CCA request then basically you do owe it, but are just trying to wriggle out of it.

If me I would stick with a basic "prove it" letter like the above, and hold CCA etc in reserve depending on what they reply with.

As said, make sure they haven't slapped a default etc on your credit files. If they have or do then that would need to be dealt with, and would be added as a formal complaint and matter of dispute.

In other words, this debt cannot be more than say 5 years old, so any default associated with it would certainly be new enough to go on your credit files if Freds/HPL have taken over the right to share the credit account data and shopacheck at that time reported defaults.

Ahhh.....

Seems the shopcheck registration was converted/transferred in 2009.

Incorporation under the previous was actually 1998.

So could be very much older than I thought.
