Can I request CCA even if I have been paying?

    Thanks Nibbler. So I'll request again and complain they didn't pay the postage. If I still don't get the data I request an assessment to the ICO. Can I also assume without the CCA, which neither OC or DCA have supplied, this debt is unenforceable? I'm only asking because I know I owe less than they are saying and don't want to pay more than I owe.

        I thought the same :-) I'm just going to ask them to deduct it but as they sold it they would have to pass it onto the DCA. I just couldn't believe they didn't pay full postage. Very little data given for £10 charge.

          one better is report them to ICO, as charges are incorporated within, see what happens, = another admin error????? I would.

            you should definitely complain tho ... the SAR should be sent to you with enough postage to cover it (and signed for too)!

              Yes you can make a CCA request at anytime if a debt collection agency is involved it should be sent to them.

              All you will receive with a CCA request is the agreement or a "reconstituted" agreement consisting of:

              The terms and conditions of the agreement at inception and closure of the account, having your name and address as at inception,
              and the creditors name and address at inception.

              Any material amendments to the Ts & Cs during the life of the agreement, any documents mentioned in the Ts & Cs.

              A current statement of the account (not an historical one) .

              As to info on payments made you may have to make a Subject Access Request under the DPA 1998 to the original creditor.
              A statutory fee of £10 is payable the creditor has 40 days to comply.
