  • Calamity Jane v IQOR

    This is a catalogue debt that has been passed from pillar to post. i.e Moorcroft, Face2Face, Phoenix Recoveries(uk)Limited and IQOR.
    I was paying Face2Face £5.00 a month but got behind so it was passed to IQOR who have been pestering me ever since. I managed to get them to stop ringing me but have now received a Notice of Legal Proceedings which says if I don't contact them they may start proceedings without further contact.
    If I send a CCA request and request a letter of Assignment is this likely to be passed back to the catalogue co. ?as I would rather pay them than some DCA who'se bought the debt for a fraction of the amount owed.

    Hiya Calamity Jane,

    Yes send them a CCA request, I would be very surprised if they can produce the required paperwork. Then when the next one starts on you send them a CCA request as well and again and again with each of them.
    Its unlikely that the actual catalogue will be able to produce the paperwork either. So basically until the required paperwork is produced then the account is on hold and unable to be collected on.

        Well I was going to request copy of signed Credit Agreement but I haven't had any more calls or letters from them. So I'm waiting to see if they contact me again.

        I did find a letter of assignment but I'm 99% sure I didn't sign a Credit agreement.(may have been the only time I did)

              Received letter today from Wescot, who are collecting on behalf of Phoenix Recoveries(UK) Limited, giving me until 16th to contact them. So I will by sending them an electronically signed request for a copy of the Credit Agreement.

                Nice.
                Now there's a couple of things that tend to happen with Wescot.

                They either run off, or send a Nelson Guest "solicitors" letter threatening all kinds of things.
                Either way we can beat em

                  2 Automated Messages left on BT Answer giving telephone number for Westcot on 11th &12th June inviting me to call them. Didn't accept, instead sent letter requesting copy of credit agreement on 12th. No further calls. Letter received yesterday from original Creditor advising they couldn't find it but providing me with a blank copy.

                      I would personally get in contact with Trading Standards and ask them to look at this on your behalf as well - they should not be pursuing this debt while the original CCA request has still not been complied with.
