Black Horse (Close Assistance)

Hear goes,

Just got a letter today off Close Assistance, reg my O/H car HP.
I know we have missed afew payments due to him changing jobs, xmas, etc.

I think we have paid at least half of the amount. It was taken over 3 years with just under one year left.

The prob is the OH doesnt work in this country so cant ring them, do we ring them or cca them ?

I think some charges have been placed on the account, not sure what.

The letter states they will be contacting him within the next few days, no further warnings will be given and we cant contact Black Horse.

Any advice on what step to take next.

for starters Blackhorse would need a court order to do anything as you have paid more than 1/3.

Can I ask why you would want to CCA them? is it purely for details on charges?

and why can't you contact blackhorse anyway????

Close ass want my OH to contact them, but hes crap on the phone and will get roped into anything so would rather do everything by letter,
Ie do they now own this debt, or collecting from Black horse????

Plus i would rather get the account passed back to them so we could make some formal agreement to paying the arears off....

ahhhhh good plan.

Don't know anything about Close Assistance I'm afraid, so don't know how they will react to a CCA .

You could cca, mention penalty charges and they will probably pass back. I doubt they have bought the debt as BH are supposed to inform you in writing beforehand.

Can't you get a notice of authorisation from hubby?? At least then you could deal with thing instead of easily lead hubby

I have read about them OTR and i dont think they are very nice, but will get him to send a letter in with a CCA will do that now.

Do you think i should DPA Black horse as well, just to see what they say plus cca them...

If you don't have a copy of all the statements and you believe there to be penalty charges of some kind, you could either ring them and ask for a print out of all the transactions in and out of the account. I did this with BH and they just printed it off and sent it to me with no probs.

You could try the same, if it fails DPA them but they are allowed upto 40 days to provide this information and I assume you could do with it a little quicker than that.


A cca is to prove availability and content of a regulated agreement, if you feel as though this is in question then cca them.
But as you are happy with the debt (sort of) then i see little point in sending cca to BH. Thats my opinion anyway

I dealt with Black Horse for my son, nothing major, just changing the date of his d/d etc, but they were very nice and helpful. And they did what they said they'd do in record time.

Been very busy...arghhhh.

Ok sent sar to close...heard nothing at all....next thing court papers arrive to get the car back...:tinysmile_hmm_t2:

well the good news is....( if there is such a thing ) we have made a suspended agreement with BH and can keep the car they took our lowest offer of payment.

there are approx £900 in charges to claim back but think im going to wait till everything is done and dusted in court...
