  • Keynes Collections - Notice of Intended Legal Action - urgent advice please

    Hi All - my first post - can somebody help me. Basically:

    Compello/Raven/MKRR whoever purchased an old credit card debt from Marks & Spencers and they have chased me for payment around 6-8 months - which I ignored. However I have now received a Notice of Intended Legal Action from Keynes and have very little time to respond ie 2-3 days as I thought it would be a standard blah letter and did not open till yesterday.

    In any event I defaulted on my M&S card at the end of 2007 as my marriage was in free fall plus I was then diagnosed with cancer, followed by Clinical Drepssion - it was not a happy time.

    Subsequent to this I did then make an arrangeement with Lowell or McKenzie Hall - can't remember which but was struggle with debt and stopped making payments. I am not sure whether I made the last payment in 2008 or 2009 - which is not like me as usually I have every bit of paper going back for years! So I am really not sure if the debt is statue barred or not.

    My question is how do I respond - is there a standard response/letter I should send stating I beleive the debt is statute barred (even though I am not sure) and also asking them to send the credit card agreement - which I don't believe they will be able to do as I think the card was issued around 2002/3,
    or do I simple ignore as some other sites advice. To be honest I don't really want to do this as I have paid off a lot of other debts and have managed to get credit cards again now, so I don't want this to affect my credit rating again if they do take legal action.

    Although I do note that their letter states "legal action to recover the debt may be taken against you" and yet none of their operating company's has done so yet - so do think it may be just a threat of action.

    My other option is whether to just offer them £50.00 per month to have done with it.

    Was this a charge card which was upgraded to a Credit card?

        Dear Sir/Madam

        Re: Your Reference No: L0ll

        Firstly, no debt is acknowledged to you. You have contacted me regarding the account with the above reference number, which you claim is owed by me.

        Secondly, I would point out that under the Limitation Act 1980 Section 5 that the alleged debt is Statute Barred.

        The OFT under the Debt Collection Guidance on statute barred debt state that ‘it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period.’

        Unless you can provide evidence of payment, written acknowledgment of any outstanding debt in the last 6 years and a copy of the signed credit agreement, I should be so grateful if no further contact is made.

        Should you continue to harass me regarding this alleged debt without providing the documentation required then a complaint will be made to the Financial Services Ombudsman without further notice.

        In addition, this letter will be brought to the attention of the court if any proceedings are issued in respect of the above.

          Would it be statute barred yet? You say you possibly made payments in 2008 or 2009. That would be mean it would be SB between 2014 and 2015 depending on which date the last payment was made. It is 6 years from the last payment
