  • Question about charging orders...

    Would it be possible that a debt buying company would buy up debts with the main aim of gaining charging orders on peoples properties, as I think this is may be what is happening to me?

    I have an ongoing issue with a creditor who has bought a debt that I thought that I had paid off the settlement figure for but the solicitors didnt cash the cheque I sent them and their client has subsequently sold the debt. Ive done a bit of digging and it seems the Spanish owner of the company has also bought a domain name with his company name (eg xxx) "xxxxxx-properties.com"

    Is this/ could this be a bit fishy??

    I've replied to your other thread. Charging orders can be obtained for any debt over £1000. Debt purchasers buy debts in bulk without being aware of whether the debtors own property or not when they buy the debts. Obviously they would like to obtain a CO if possible, however, they would have to obtain a CCJ before they can apply for a CO.

    If the debt is in your sole name and the property is jointly owned, then they can only record a restriction, but, as above, this requires a CCJ.
