Im new to this and not sure if this is a debt issue or an employment one!
Yesterday I received an email and letter through post from Daniel Silverman claiming I owe £4800! And threatening all sorts if I don't pay in 7 days! This was marked 'final demand' as if to suggest I knew about it! I didn't....
So it transpires it's my previous business partners claiming I owe the company this money!
Quick background, I was a director of company A and was convinced to give up a well paid job in April 2013 to work full time. I was made many promise including being made director of company B and being given shares to reflect my contribution and commitment. None of this happened and there was constant moving of goal posts. I would be made promises that things would be sorted and then nothing would happen! So in jan 14 I said I was going to leave. They again threw lots of promises at me and paid me a guaranteed amount at the end of Jan (previously my salary was commission based), however the promises once again failed to happen and one of the other directors actually produced a contract completely different to what had been agreed. At this point I knew I had no option but to go. I knew I wouldn't get paid and I also had expense which had not been paid for my entire time there despite me asking and so I took my pro rata salary and my expenses from the company account- I was fully authorised to take money from the account as I did all the payments. I prepared a full hand over and made sure everything was up to date and even prepared invoices for the next month. I sent a resignation letter and detailed my reasons. I had a text from one director and nothing from the other. I also had a couple of texts asking me for help with things which I said no to! And so 4 weeks later the email/letter mentioned came as a surprise!
They claim the guaranteed payment for Jan was a 'loan' and I wasn't entitled to the other money! I have asked the DCA for paperwork to substantiate this and they have said they're waiting for it from the client BUT how can they be sending threatening letters with no proof?? No proof exists and so I'm not sure what they plan to send?!
What should I do? It's completely disgraceful although it doesn't surprise me! Both of them have no morals and treat people appallingly.
even though I was a director I had no contract and was self employed. I kept asking for a contract but this was another thing that didn't happen.
