    Hello,

    I need some advice with a problem I'm having at the moment with Lowell.

    I received a ccj which was issued by default in September 2013, I did not know about this until I received a warrant of execution from the county court. The county court bailiff has already been out so I am running out of time.

    The debt is for a mobile contract taken out 5 years ago in my name. I don't remember having an account with the mobile company. I called the mobile provider and supplied the account number provided by Lowell and although the account number is on their system with my name and old address, there is nothing else on file. Just a note saying disconnected. The person on the phone asked if I had taken out a contract and cancelled within the 7 days but I said I have no memory of it at all. Then when I asked if I submit a SAR would that come back with nothing too and she said yes.

    What do i do now? I have 2 more days at a push to submit and n244 or n245. I don't remember ever having the debt so is it possible that Lowell have the information to prove it otherwise?

        So you were living there when the contract was allegedly taken out in your name.

        What is the name of the mobile 'phone company?

          I called the mobile provider back just to make sure and they confirmed my details, name and address at the time and bank account details I don't recognize however, I did have another bank account about 7 years ago. What confirmed it for me was that the registered email was mine so it looks like I did take it out. Anyway they don't have much more information based on facts and figures. I'm aware that the dca has assigned the debt which under the property act 1925 is completely ok.

          As the bailiff has already been out, i am desperately running out of time added to the fact that I didn't even know of the ccj and so have never disputed, requested or been supplied with breakdown figures or proof that I owe the dca specified amount.

          I really don't know how to go forward, do I just fill in an n245 and request lower installments i can afford?

            dunno if this is too late, ask lowlifes for a copy of the credit / contract agreement - (DO NOT SIGN YOUR NAME OF THE LETTER BY HAND), make sure you make it clear you are not acknowledging the debt.

            They have to prove its you & yours. I know the phone company doesn't have any info, but maybe a way around it?
