  • Help please: Lowell - Review of Payment Plan?

    Hi Guys,

    Today I have received 3 x of the same letter in the post from Lowell Portfolio. As described in this thread , I am paying back £100 per month to clear 3 defaulted accounts.

    Basically they want me to call them so they can review my personal financial circumstances to see if I can pay more. The thing is, I have sent Lowell CCA letters for 2 of these accounts and sent a SAR to Lloyds Bank so I can work out PPI charges and submit mis-sold PPI claims. Assuming the claim is successful, I or they will appropriate the refund and deduct it of the debt amounts.

    Whilst this is going on, how should I respond to these "review" letters please?

    IGNORE them. They are being greedy. NEVER ring them as they will threaten and bully you into paying more than you can afford. If they do not comply with your CCA requests within 12 working days the you can legally stop paying them until they produce valid CCAs

      Ah thanks, thought so - so are you saying I can legally cancel 2 x direct debits if they do not produce the documentation when 12 working days has passed - sent 20th Jan? Therefore assuming that they received the letter on 21st Jan, then 12 working days after that is the 6th Feb 2014, so could I technically cancel the direct debits with Lowell then?

      I'll still have to continue paying back the overdraft though.

        ...and even if they do produce CCA's for two of the accounts - what would happen if I ignored the "payment review" letters?

          Nothing. They agreed the payment with you and unless your circumstances have improved dramatically then i doubt whether you can afford to pay them any more. They have NO LEGAL right to demand you phone them

            Great, thanks ODC - I'll just ignore them. Just one more thing (sorry for the cheesy Columbo line), would the 6th Feb 2014 be the right date to cancel the direct debits with them if they don't product the valid CCA's? To be honest, I kind of want to carry on paying it off with what I have arranged with them. I am waiting for Lloyds to reply to my SAR letter and provide me with everything so I can submit a mis-sold PPI claim to hopefully, if successful, use it to take a chuck out of the debt.

            Tell me if I am wrong here but I imagine Lloyds have nothing to lose anyway - the debts weren't paid back with them directly, and they've whacked all the PPI charges on that debt - now I am paying it back monthly with Lowell - surely they'll just take off what they put on without the need of sending me a cheque or other form of direct refund.

                It's your decision. Its 12 working days from your application plus 2 days to allow for postage

                  I could bet you £1m that they won't produce them, they'll have to go back to the original lender to obtain the documents. It's your decision whether you want to stop payments or not. As long as you pay, the debt will never go statute barred.

                  If they can't produce an enforceable agreement, you can sit it out for 6 years like some of us are doing. :thumb:

                  Normally any redress would go towards reducing the debt, however, there have been some cases where the debt has been sold, where the redress has been paid to the debtor, just don't count on it. :tinysmile_twink_t2:
