    Hi everyone,

    This is my first post and I need some help. I apologise in advance if this is confusing.

    I have just received a three part letter from Lowell. Stating they now own the debt of £4050 from HFC. HFC informing me that they have sold the debt to Lowell and an arrears notice from OFT.

    I took this loan out with HFC between 1999/2001. I fell into financial difficulty and could not pay. I remember it went from one Debt Collector to another and I eventually received a CCJ and the debt went to approx £6000.

    I went with a debt consolidation company and paid a monthly repayment for this debt. this payment was made up until 2009 when I separated from my wife.

    So there has been no payments made on this account since late 2009. I have heard nothing from any Debt Collector until now!

    I have had several different addresses since we split and they have even managed to get my home number!!! 4 calls in two days. I'm concerned they will start to call my work.

    I live on my own and only just make ends meet each month. I can't pay this please help me.

        You say you have a CCJ but also that you took out a consolidation loan. Presumably you paid off the CCJ with the consolidation loan and then paid monthly installments towards the loan. :noidea: If so, the CCJ would have been satisfied, and if anyone was chasing you, it would be over the consolidation loan rather than the CCJ, yet you say Lowell are chasing you over the HFC loan.

        Can you clarify what you did when you took out the loan? Did you pay off the CCJ with it?

          ok sorry.

          to clarify, all the debts I had went with a debt management company Gregory Pennington. This included the loan from HFC which had a CCJ. The CCJ fell off of my credit file because the 6 years had elapsed but the debt is still outstanding.

          I never took out a consolidation loan just paid Gregory Pennington a huge monthly fee to manage my debts.

            From what you say above, it sounds like Lowell are not aware of the CCJ. I would be inclined to respond with a prove-it letter and see what they come up with. Whether they mention a ccj... :noidea:

            As the CCJ has dropped off and hasn't been enforced in years, Lowell would have to apply to the court to enforce it, and the court would question the fact that no enforcement action was taken in so many years.:juge:

                You have contacted me regarding the account with the above reference number, which you claim is owed by myself. I have no knowledge of any such debt. I am familiar with the CPUTR 2008 and the Office of Fair Trading's Guidance on debt collection, which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

                I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable and in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive and unfair methods. Furthermore ignoring and disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical & psychological harassment.

                I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question and await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions.

                    I decided to temporarily hold off on the prove it letter and just wait to see what their next move would be. Today I received a letter from Lowell informing me that they had recently written to me stating they had bought the debt and that they have not heard from me. So HFC had requested they contact me again. They say that they are here to help pay the debt and that making payments could increase my credit score.

                    This is bizzare because it is in no way threatening and appears to be very polite? is this the calm before the storm?

                      So HFC had requested they contact me again.
                      A lie. If they have bought the debt from HFC or from another, debt collecting parasite, HFC has no further interest in the matter.

                      Another lie. Bowells exists solely to make money from other people's penury.

                      Yet another lie. Making payments to a debt that has dropped off your credit file will make not one scrap of difference to your credit score.

                      No. It means that they have looked at your credit file, were unable to see the debt and hence have concluded that it is time barred under the Limitations Act 1980.

                        We got loads of nice friendly letters from them and their buddies very tempted to invite them round for tea and biscuits .WTF do they think im that stupid????

                          I have been unfortunate enough to have dealt with these people in the past. It just seems too polite and im sure its not statute barred just yet.
