    Good afternoon people. I am having a little problem with a company called Capquest. They are adamant that i owe them £85.00 on a mobile phone contract which is totally fictitious.

    I have followed advice given on this forum and placed the account into official dispute and demanded documentation to prove their claim.

    Three months later i receive their response.

    They state that a mobile phone agreement does not need a credit agreement, only a service agreement. I have confirmed that is correct. I have been told that i, myself will have to locate this service agreement direct from orange and that Capquest have no lawful respnsability to facilitate that request. They are now saying they will be passing this account back to collections if no contact is made within 30 days.

    So my question has to be:

    How can a Debt collection company demand a payment from an individual with no requested paperwork. There must be some sort of protection for the consumer. Any recommendations on my next step please.

    In which way(s) is it "totally fictitious"?

    First of all, did you ever have a contract mobile telephone from Orange?

      If I had never had a phone contract with this company I would write a letter to the DCA and tell them where to go and contact the phone company to double check.

        Sorry, more information. The account was linked to an address i moved out of 5 years previous. Might be ID fraud but after 5 years since i moved out???

        It still does not answer the question. This debt agency expects me to get this so called service agreement. If this agency is demanding money off me, do they not have to have it or use it for court?

        This is fraud and nothing to do with me but i am trying to see what signature is on this contract
