  • Lowells Advice Needed!!!

    Hi Guys,

    I have an old Lloyds TSB which will become statute barred in 5 months.

    Lowells have bought the debt & have been pursuing me for some months now.

    I asked them to provide me with proof so they've sent me some old bank statements & now have requested I establish contact with them within 7 days or they reserve the right to instruct solicitors without further notice, if I don't agree to pay the debt which is for £1475.

    I disputed the debt with Lloyds years ago & have disputed it with every debt collection agency since.

    Is it worth contacting them as the debt will become statute barred in 5 months?

    The only problem is that since I work for a finance company I'm worried because I can lose my job if I get a CCJ!

    All help is appreciated! Thanks in advance!

    Have you sent a s78 request to Lowell?
    what dispute did you have with Lloyd's ?
    "Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin.       Thanks for your reply.

      I sent them a copy of letter saying I didn't recognise the debt & they'd need to sent me a copy of the credit agreement. I don't know if that's a s78 request?

      They responded by saying that they didn't need to as it was an overdraft but would send me statements, A month later the letter in question has arrived.

      The dispute was that they got the dates of my standing orders wrong, which resulted in my account becoming overdrawn & then made charges against the account.

        ^^^^ you refer to them sending you old bank statements. Does this suggest that the debt may relate to a current account overdraft and not a credit card agreement which means s.78 request may not be appropriate (except as a stalling tactic)?

          Can you clarify if your account would have remained in credit if you had not had that standing order problem (with those added charges) in 2008 ? In other words if you have not used the account for nearly six years would the balance still be in credit today or at least not overdrawn? What needs to be established is whether the bank has a justifiable claim against you even if it's for a lower amount if you haggle to get the historical disputed charges removed. Did you make a formal complaint about these charges in 2008 and what was the outcome (FOS?).

          What is the reason for not using the account for almost six years?

            The debt is an overdraft from an old Lloyds current account.

              Hi,

              The account has been closed & the debt sold on to Lowells.

              I contacted the bank when it happened & disputed it. They just passed me from department to department.

              I was young when this happened & didn't know about the FOS.

              I've now sent Lowells a letter asking them to transfer the debt back to the original creditor as the debt is disputed & has been for over five years.
