  • CCA Help

Hi I'm new to this forum and wondered if anyone can advise.

I currently have a Step Change DMP from 2009 with 11 creditors as follows:

Marlin Financial Services (formerly Lloyds TSB Credit Card)
    Barclaycard
Allied International Credit (formerly American Express)
Direct Legal Collections (formerly MBNA credit card)
Apex Credit Management (formerly Egg Loan)
    Argos Card Services
Moorcroft Debt Recovery (formerly Citi credit card)
    Studio Catalogue
Debt Managers Ltd (formerly Next store card)
Santander (formerly Alliance and Leicester overdraft)

These debts are all taken out between 2002 and 2006.

I have just sent CCA letters to them all as advised independently. The 12+2 expiry date is 27/01/14.

My question is do I continue on my DMP until they reply, or suspend the payment and pay them myself if need be. I've been advised that the majority of these DCA's are simply cash cows and to stop payment immediately.

    Please advise?

Your debts will almost certainly be unenforceable, having been in your situation I'd stop paying.
With Christmas over your list of creditors looks like a bunch of leftover Turkeys.
Save your money for future battles.

Thank you for your advice, what happens if I stop paying?

And battle? I take it I'll be bombarded with letters and telephone calls?

Suggest you read up other postings on unenforceable debts.
You need to be resolute and follow the advice of other posters.
If you have unenforceable agreements you're in a better negotiating position for either f&f or the full 6years till SB.
However until you get the paperwork returned you won't know what your position is.
After 6 weeks not one of my creditors has returned an enforceable agreement.
          It's your decision.

There are a whole raft of template letters on this and other Forums which are there to counter harassment and other threats, you won't be alone.

A cca request can be made at any time.
If a debt has been defaulted it remains on your credit file for 6 years regardless.
If you don't want a default then continue paying, it depends on individual circumstances.
If the debt is UE and your credit file is trashed and you do not intend to get a mortgage anytime soon or any other credit then there's little to lose in non payment.
I'm advising from personal experience only, everyone's circumstances are different and I would always suggest that people thoroughly research further.
I'm a self learnt amateur and not necessarily legally equipped to give 100% advice.
I'm sure other posters will join in and comment.
