    Hello all at LegalBeagles and Happy Everyday !:reindeer:
    After a year of silence the 'Losers' tried it on again on a disputed 8 year old loan with a 'hello we are passing it on to' warning letter received 19th December.Posted recorded delivery 'Prove it ' letter (100% sure alledged debt had had no acknowledgement or payment in 7 years) on 20th December.Today received letter from Losers stating 'Whilst the information available to us indicates your account is due and payable,we will in the circumstances take no further action and close your account' BS !

    If Bowells do not serve you with a Statutory Demand in the New Year, they'll probably sell the alleged debt to some other numpties.

      Thanks for that info Wolfhound.If Bowells do as you suggest,would I have any legal recourse as they have stated that the account is closed ?

        Unfortunately not, as the position in English Law is the the debt is merely incapable of being enforced through the courts, but that the debt still exists.

        In Scots Law, the obligation to repay the debt is extinguished after five years; the debt may still exist thereafter but one is not obliged to repay it.

        In Irish Law, I seem to recall reading that it could be a criminal offence knowingly to press for payment on a statute barred debt.
