Lowell - can't believe it but I think it's statute barred, please confirm :)

    Hi all

    I'm sure my maths isn't wrong, but you know when you can't quite tell yourself you're correct and need someone else to say it...?

    OH had a letter a couple of days ago from Lowell about BOS, who apparently sold the account to Lowell in August last year. Lowell are just telling OH now.

    Them writing to him has prompted me to check his credit report, and afaics BOS defaulted the account in July 2007. Please tell me I'm right, and that I can send my very first Statute Barred letter!

    Was it a overdraft, loan or credit card account??

    When the default was registered has no bearing on whether a debt is Statute Barred or not as the creditor frequently register defaults on credit file before they are legally allowed to and also after when they are supposed to

    I myself have 2 different accounts with defaults
    one was registered on my credit file 1 month before an DN notice was produced
    one was registered on my credit file 3yrs after any monies had been paid to the account

      I had a proper 'Doh' moment when I read that Gorang, thank you! I knew that. I knew I knew it, but obviously had a bit of a mental block about it all.

      Turns out after checking the files that OH stopped paying in July '08, and since then all correspondence has been headed 'I do not acknowledge' etc. I guess they've had it on their books for a while and now there's 6 months to go before it is really SB they've woken up.

      OH has had the initial letter, then one from Lowell Financial (why do they bother with the different names ffs?), and a couple of calls made to my mobile (hasn't been OH's number for years).

      I'm just jotting down a quick get lost letter to them, and will acknowledge further mail but not respond. I know this account is kaput (CCA/Default/Termination are all screwy) and when I have previously requested information under CPR following one of BlairOS's lovely NIP's it's been ignored, so it's not worrying me. More just irritated that I'm having to go down the route of making sure I reply so it doesn't look like it's being ignored.

      Ho hum, only 6 months to go...
