        The should be reported to the OFT, the body responsible for consumer credit licensing. But they seem as useless as the FOS!

        You would think so, wouldn't you? That was just ONE example I could find quickly, they make a habit of it, in fact, the person whose friend posted today had one dated 2 weeks early!!!

        If we are all to be honest we would if we owned a DCA choose the cheapest most effective way to scare people into paying.All the time its legal they will do it.
        It shouldn't be legal to date them weeks early, that's cheating, plain and simple!

        Also using SDs as a debt collection tool is an abuse of process, they should be going down the CCJ route rather than the insolvency route to recover debts. They issue SDs because they often haven't got the paperwork required in court, so they try to scare people into paying without questioning the paperwork.

        They usually are, although a few are sent by post, most of Lowells are properly served. But the cost of service is nothing compared to the costs they've often had to pay to Cel & Co.

            I understand where your coming from but it doesn't seem to be a scare tactic if they are doing giving little time to defend (probably not right terminology) but just read thread where sd issued 24th September, was received 9th October and cel needs everything by tomorrow. That's intent because if it's a large amount no amount of scaring could get you to pay it in one go.

            Or am I missing something? Do they give you the opportunity to set up an arrangement in that time? If they do then I understand the "scare"

                Yes you can often set up arrangements when an SD is served.

                If they want me to i will pop to Leeds to pick mine up personally and save them the cost.

                But the OFT clearly say they should not be used as a debt collection tool. There again they are a bunch of tools.

                  Reading some of the post on here from those who receive a SD its a scare tactic indeed,problem for Lowells is those who come to LB get help from Celestine.
                  This must be just a small number of debtors or alleged debtors that receive a SD we cannot know how many pay up or come to a payment arrangement before court.
                  As anyone can read there are some of us on here who would welcome a SD as we have no assets but large debts I for one would welcome bankruptcy although as I can never pay what I owe I don't let it get me down.It would be a miracle if Lowells sent me a SD,good job to Celestine cant fight for everyone but I suspect she would have a good try luckily for some she is hear.

                      So does a stat demand have to be:- a) hand delivered directly to the person? or b)just delivered and put through the letterbox? or c) can it be posted to the last known address?

                        Hi, from what I understand and I stand corrected if I'm wrong, it Is meant to be hand delivered. I'm unsure if it can be posted to last known address, I know ccj papers can be issued to last known address.

                          Google serving statutory demand. They should serve by hand or use a process server. It can be put through the door or send recorded delivery. I think using a last known address makes it easy money for Kate.

                            Initially it has to be served in person, but once that has been attempted and failed, substituted service is acceptable: http://www.insolvencydirect.bis.gov....10/part_10.htm

                            45.94 Service of the statutory demand
                            The creditor is bound to do all that is reasonable to ensure that the demand is brought to the debtor’s attention, including personally serving the statutory demand on the debtor if practicable [Note 5].

                              It should be but, until/unless the Office of Faffing and Twaddling has been officially notified of this - and it still cannot act on complaints by mere members of the public whom it is supposed to serve - it is "unable" to do anything.

                              Besides, they'd probably accept the excuse that it was a mere accident, oversight or the result of happenstance, even though Lowlifes do that again and again.
